Student Loan | Fitch Affirms Senior Notes & Upgrades The Sub Note ...

NEW YORK?(BUSINESS WIRE)?

Fitch Ratings affirms the senior notes at ?AAAsf?, and upgrades the subordinate note from ?BBBsf? to ?Asf? issued by Nelnet student Loan Trust Series 2004-3. The Rating Outlook on the senior notes, which is tied to the sovereign rating of the U.S. government, remains Negative, while the Rating Outlook on the subordinate note remains Stable.
Fitch used its ?Global structured Finance Rating Criteria?, and ?U.S. FFELP Student Loan ABS Surveillance Criteria?, as well as ?Rating U.S. Federal Family Education Loan Program Student Loan ABS? to review the ratings.

The ratings on the senior notes are affirmed based on the sufficient level of credit enhancement to cover the applicable risk factor stresses. Credit enhancement for the senior note consists of overcollateralization and projected minimum excess spread, to cover the applicable basis factor stresses for each rating category.

The rating on the subordinate note is upgraded to ?Asf? from ?BBBsf? due to the sufficient level of credit enhancement to cover the applicable basis factor stresses at the ?Asf? rating category. Within the transaction documents, the reserve account is excluded from the parity calculation when the pool factor declines below 40%. Fitch has recalculated parity, giving credit to the cash in the reserve account, which is currently at the floor of $2,011,386. As the transaction amortizes, the reserve account will not decline and parity (as calculated by Fitch) will continue to grow. In addition, the subordinate note has been receiving principal payments along with the senior notes since it passed its stepdown date.

How Much Do They Know About Me In The 'Cloud'?

What do Google's computers and Facebook's, and Amazon's, and Verizon's, and all the other Internet servers know about me?

They know a lot, says Mark Rigely of San Francisco. His strangely beautiful video shows how emails, ISP data, weblogs and voice data are being used to paint our portraits, and how, with time, those portraits become dense with detail, pattern and personality.

It's almost like there's an image of us accumulating in that Cloud that will become an ever more vivid copy, with information we wouldn't tell our best friends, our family or our spouse. But the Cloud knows.

"The average user will have 736 pieces of this personal information collected every day," Rigeley says. What a specific number! I don't know enough about information technology, but I'm trying to think: Is that phone numbers dialed? How long we talked? Key words? E-mail sent? Bills paid? Sites visited? How long I stayed? Tolls I paid? Subway rides taken? Destinations? Entry points? Groceries purchased? Prescriptions filled? Clicks I clicked? What else? Seven hundred and thirty six is a hard number for my imagination to conjure. And that's just one day.

Rigely is a graphic designer, based in San Francisco. He says that "by visualizing the processes that underlie our interactions, we can trace what happens to the information we feed to the network."

He does it very well. But when he shows me what's happening, I feel so exposed.


Last week I wrote about The Right To Forget, a legal doctrine which may soon become law across Europe. It says that embarrassing pictures, unguarded comments and telltale transactions should not live forever on Internet servers; that if you want to, you should have the right to demand that Google or Facebook "forget" that information, make it go away.

I thought such a law would be hard to design, but valuable. Rigely's video only makes the privacy argument stronger. What he's describing is ordinary data, nothing specifically naughty or embarrassing. But if you collect enough of it, as Michael says, "Over time, this information amounts to the user's digital identity." And who owns that virtual you? Not you.

Haverfordwest Magistrates Court heard that on March 25, 2010, Kraus was instructed to remove a concrete block that had been placed across a doorway. As he proceeded to throw the block, he fell backwards on to the balcony and then seven metres to the ground below.

An HSE investigation found that the three-story house was being built without scaffold or any form of fall prevention.

Preseli Construction & Maintenance Ltd. and its director, Christopher Newell, had failed to ensure that work at height was properly planned and supervised. They also failed to ensure that it was carried out in a safe manner.

Kraus spent six days in Morriston Hospital in Swansea where he underwent surgery to pin the bone in his left heel and was in a plaster cast for approximately ten months. ?Still in constant pain and unable to walk on uneven ground without risking a fall, he is due to undergo further surgery to prevent any further damage to his foot, but his career in the construction industry is over.

Preseli Construction & Maintenance Ltd. of Waterloo Industrial Estate, Eastern Avenue, Pembroke Dock pleaded guilty to breaching Regulation 4(1) of the Work at Height Regulations 2005. It was fined $7,671.6 and ordered to pay costs of $1,519.37. (WCxKit)

Newell of The Glebe, Narberth Road, Tenby also pleaded guilty to breaching Section 37(1) of the Health and Safety at Work etc. Act 1974. He was fined $ 2,557, with costs of $1,519.37. Honoring Patients? Treatment Choices at the End of Life: New Tools, New Challenges, New Limits

Hamline University School of Law, Saint Paul, MN, November 8-9, 2012

The Health Law Institute at Hamline University and the Hamline Law Review seek proposals for presentations and papers for our all-day fall CLE/CEU Symposium on Friday, November 9, 2012. Our Symposium will examine the problems and solutions to issues currently arising at the intersection of medical law and end-of-life care.

TOPICS: Potential topics include, but are not limited to:
- Legal and medical issues concerning the use of POLST orders, especially in Minnesota;
- Institutional and community responses to medical futility disputes;
- Legal issues involved in end-of-life planning, including advance directives, health care proxies, DNR orders, living wills and the initiation and cessation of artificial support systems (such as artificial nutrition and hydration);
- A view of the decision-making process in end-of-life cases from the perspective of the parent, the family and the medical provider;
- Decision-making for the ?unbefriended? patients without surrogates;
- Role of lawyers, guardians ad-litem and the courts in end-of-life cases;
- Applicable legal and medical standards in end-of-life cases;
- Ethical issues related to the roles of attorneys, medical providers and family members in end-of-life decision-making; and
- Any other related topics.

SUBMISSION PROCEDURE: Anyone interested in speaking at the Symposium and/or publishing in the Hamline Law Review?s Symposium issue should submit both a CV and a 500-word abstract to: healthlawsym2012 [at] hamline.edu by March 30th, 2012.

A committee will review the abstracts and will invite applicants to speak at the symposium and/or publish in the Hamline Law Review. New Haven, Conn. ? Yale scientists have discovered the molecular pathway by which maternally inherited deafness appears to occur: Mitochondrial DNA mutations trigger a signaling cascade, resulting in programmed cell death. The study is in the Feb. 17 issue of Cell.

Mitochondria are cellular structures that function as "cellular power plants" because they generate most of the cell's supply of energy. They contain DNA inherited from one's mother. Mitochondria determine whether a cell lives or dies via the process of programmed cell death, or apoptosis.

The Yale scientists focused on a specific mitochondrial DNA mutation that causes maternally inherited deafness. The mutation occurs in a gene that codes for RNA in mitochondrial ribosomes, which generate proteins required for cellular respiration. The team found that cell lines containing this mutation are prone to cell death not directly due to the mutation, but rather because it enhanced a normal chemical modification of the RNA called methylation, which regulates ribosome assembly.

"Our lab had previously discovered that overexpression of the enzyme responsible for this methylation could cause cell death, even in cells without the deafness mutation," said corresponding author Gerald S. Shadel, professor of pathology and genetics at Yale School of Medicine. "But when the researchers overexpressed the enzyme in mice to mimic the effects of the mutation," he said, "we were astonished to discover that the animals progressively lost their hearing, reflecting how such disease would develop due to a known pathogenic human mitochondrial DNA mutation. This new mouse model will be instrumental in understanding genetic and environmental factors known to impact mitochondrial disease pathology."

The researchers found that reactive oxygen molecules produced by diseased mitochondria are what trigger events leading to a cell death-inducing gene expression program. By genetically depleting the protein ultimately responsible for activating this programmed cell death response, they were able to restore normal hearing to the mice.

The study not only sheds light on inherited deafness in humans, but possibly also age-related hearing loss and other human diseases. First author Nuno Raimundo, a postdoctoral associate in pathology, said, "Mitochondrial diseases are complicated because different tissues are affected in often unpredictable ways. Defining the molecular mechanism underlying death of only a specific subset of cells in the inner ear is a major step toward unraveling this complexity."

2 New England utilities agree to buy wind power (AP)

BOSTON ? Energy companies Northeast Utilities and NStar have agreed to buy more than a quarter of the power produced by the long-planned Cape Wind offshore wind farm as a condition of a proposed merger, state officials announced Wednesday.

The announcement is a huge boost for the 130-turbine Cape Wind project, which would be located about 5 miles off Cape Cod in Nantucket Sound and aims to be the nation's first offshore wind farm.

The Cape Wind project has sold half its power to the Massachusetts utility National Grid but has struggled to find buyers for the rest of the power, posing a major obstacle to its efforts to secure financing. As part of the deal announced Wednesday, the combined Northeast Utilities-NStar company would buy 27.5 percent of the electricity Cape Wind produces under a 15-year contract.

State Energy and Environmental Affairs Secretary Richard Sullivan said the agreement shows the administration's commitment to clean energy.

The agreement between the state and the utilities also calls for a four-year freeze on base energy distribution rates and a one-time $21 million credit for ratepayers. Attorney General Martha Coakley said the deal would save Massachusetts consumers an estimated $217 million.

Even with the agreement, Hartford, Conn.-based Northeast Utilities' $4.7 billion purchase of Boston-based NStar still needs final green lights from utility regulators and other officials in both states.

Cape Wind spokesman Mark Rodgers said the company was waiting to land another customer before pursuing project financing, and now it can, once the deal is final.

"The more power that is secured in a long-term power purchase agreement, the better," he said. "It helps attract the private capital that's needed, both in the form of debt and equity to build the project."

The price NStar and Northeast Utilities will pay for Cape Wind's power is still subject to negotiation, NStar spokeswoman Caroline Allen said.

Cape Wind was proposed in 2001 but has met tough resistance. Opponents say the power is overpriced: For instance, the starting price in the National Grid deal is 18.7 cents per kilowatts hour and increases annually, while land wind can be had for about 10 cents an hour. They also complain the project will mar a pristine area. Various lawsuits are pending against the project.

NStar initially seemed cool to Cape Wind, with chief executive Tom May saying he was "agnostic" about the project. The utility also passed on buying from Cape Wind when it first had the chance, choosing cheaper land wind instead.

Cape Wind opponents have accused the state with using the merger approval to force NStar to buy power from a favored project, but NStar's Allen said the deal announced Wednesday wasn't a result of pressure from Massachusetts officials.

Democratic Gov. Deval Patrick, during a Statehouse news conference, downplayed the relative importance of the Cape Wind portion of the overall agreement and said it was not a "sticking point" in negotiations.

"The value of the rate freeze and the potential to have rates go down is considerably more important and larger in scale than the Cape Wind component of this," he said.

Cape Wind opponent Audra Parker, of the Alliance to Protect Nantucket Sound, didn't believe it, saying state energy customers will pay more because of the state's "arm twisting" of NStar. But she said that after a decade of trying, and despite the deal with NStar, she's convinced Cape Wind won't be built and the NStar deal won't matter.

"Twenty seven percent of nothing is still nothing," she said.

EU debt crisis potential impediment to U.S. growth: Geithner (Reuters)

WASHINGTON (Reuters) ? Treasury Secretary Timothy Geithner warned on Tuesday that Europe's debt problems along with the slowdown in other major economies present "potential impediments" to U.S. growth.

"While the economy is regaining strength, we still face significant economic challenges," Geithner said in prepared remarks to the Senate Finance Committee.

"Unemployment, at 8.3 percent, is still far too high, and the housing market remains weak," he said a day after the Obama administration unveiled a $3.8 trillion budget, which proposed aggressive spending to boost the economy and higher taxes for the rich.

Geithner said the administration plans to soon release a framework for revamping the corporate tax system to help level the playing field for all companies.

Like never before, mall brands and chain stores are strutting their affordable stuff alongside far pricier glitz and sought-after hipster swank, throwing parties and setting up their own catwalks and red carpets during the frenetic, twice-yearly round of fashion shows.

That, analysts and insiders said, is due to the fashion elite's tighter embrace of top bloggers, live video streaming by a growing number of designers and the explosion of social media allowing anyone with a camera phone to tweet from the once-insular world.

"Those traditional walls have really come down," said Mike George, who heads QVC and has been hosting unofficial New York Fashion Week events for about four years. "We saw that kind of trend in its early stages, this sort of democratization of fashion."

Trend forecaster WGSN considers Levi's a sound case study as the company enters the Fashion Week fray for the first time Wednesday, presenting bits of its global line as it pushes deeper into international markets.

"Many people think of Levi's when you say `jeans.' But they're about more than a cool pair of 501s. In recent years, their design studio has been a major innovator in denim styling and this is a chance to show that off to a global audience," said Sandra Halliday, a fashion analyst for WGSN.

Len Peltier, Levi's global vice president for creative design, agreed that the New York Fashion Week moment was right.

"We're not trying to be a high fashion brand," he said, "but the lines have blurred between streetwear and fashion, and that's an exciting proposition."

The same could be said for J.Crew as it continues to roll out internationally and move from its preppy base to one that's more about trend and fashion "without losing sight of its heritage," Halliday said.

This is the company's second Fashion Week visit. "It's undeniably beneficial to be associated with other high-end aspirational brands at New York Fashion Week," Halliday said.

With 90 shows at the Lincoln Center tents, dozens more around the city and a swirl of parties in less than two weeks, Fashion Week is also something else that appeals to companies offering clothes for the rest of us: a huge opportunity to corral world media.

Following Fashion Week from afar appeals to people who perceive themselves as fashionable but aren't able or willing to shell out big money for luxury that remains dominant on runways. But they can see themselves shopping at Kohl's or picking up an outfit among more glamorous selections offered by Levi's or sold on QVC.

"Fashion evolves like anything else and maybe it isn't found in just one tiny shop in Paris anymore," said designer Isaac Mizrahi, a QVC seller who once sent dyed dogs down the runway to match his clothes.

"I love the subject of fashion and there are a lot of people like me in this country and in this world who adore it, too, because it makes them happy," he said.

Kohl's hasn't only shown up for Fashion Week but also has timed the sale of its new Rock & Republic line of premium denim and sexy shoes to coincide with the runway show.

"Key influencers from media to designers to celebrities are in New York and creating excitement and consumer interest in fashion," said Julie Gardner, executive vice president and chief marketing officer at Kohl's. "This makes New York Fashion Week an ideal venue for Kohl's."

Kohl's aside, the fashion driven among us, outside of the lucky few who get to attend Fashion Week, once waited excitedly for websites to post photos, or years ago for a few black-and-white shots to show up in a newspaper the next day.

"But we shouldn't get carried away with all the talk of democracy," Halliday said. "All of this is part of the publicity machine that creates a buzz around the event, and the brands that are still out of the reach of most consumers."

Fern Mallis is the former IMG senior vice president who built the buzz to begin with when she launched Fashion Week in 1993 while executive director of the Council of Fashion Designers of America. She stepped down from IMG in 2010 to start a consulting firm and just started selling her own travel-inspired jewelry on QVC.

"Fashion Week has become an unbelievable engine," she said at QVC's runway show the night before Fashion Week officially opened last Thursday.

"Everybody uses the platform of Fashion Week to take advantage of the media and the attention," Mallis said. "If those people can have five minutes or 30 minutes on the calendar, bless their heart. Go for it."

Most Teens Who Self-Harm Are Not Evaluated for Mental Health in ER (HealthDay)

FRIDAY, Feb. 10 (HealthDay News) -- Most children and teens who deliberately injure themselves are discharged from emergency rooms without an evaluation of their mental health, a new study shows.

The findings are worrisome since risk for suicide is greatest right after an episode of deliberate self-harm, according to researchers at Nationwide Children's Hospital in Columbus, Ohio.

The researchers also found the majority of these kids do not receive any follow-up care with a mental health professional up to one month after their ER visit.

"Emergency department personnel can play a unique role in suicide prevention by assessing the mental health of patients after deliberate self-harm and providing potentially lifesaving referrals for outpatient mental health care," said lead study author Jeff Bridge, principal investigator at the hospital's Center for Innovation in Pediatric Practice, in a news release. "However, the coordination between emergency services for patients who deliberately harm themselves and linkage with outpatient mental health treatment is often inadequate."

For the study in the Journal of the American Academy of Child & Adolescent Psychiatry, researchers examined Medicaid data for adolescents aged 10 to 19 years. Only 39 percent of the patients discharged after trying to harm themselves received a mental health assessment in the emergency department.

Only about half of the children who had visited the ER for a mental health-related reason within the previous 60 days received a mental health evaluation during their visit to the ER for self-harm.

Up to 90 percent of young people who deliberately harm themselves meet criteria for at least one psychiatric disorder, particularly mood disorders, the researchers said.

The U.K.'s National Institute for Health and Clinical Excellence recommends that people who show up in an emergency room for self-harm should receive a mental health evaluation before being released from the hospital.

"This study highlights the need for strategies to promote emergency department mental health assessments, strengthening the training of physicians in pediatric mental health and adolescent suicide prevention and timely transitions to outpatient mental health care," Bridge said.

On the same day that Vladimir Putin called for the Orthodox Church (who by the way believe his stint as Russia?s ruler to be nothing short of a miracle) to have a stronger presence on state-run television channels, St. Petersburg lawmakers have passed the second reading of a bill that, if made law, would fine anyone advocating gay/lesbian/other non-heterosexual relationships, effectively outlawing gay pride parades,?public displays of affection, and even conversations about homosexuality or transgender topics. ?The bill will have its third and final reading this Wednesday. ?Today?s reading was marked by a protest outside of a parliament building, at which a number of demonstrators were arrested. ?St. Petersburg?s gay rights? group, ComingOut, condemned the bill for aiming to ?legalise discrimination?, and warned that totalitarianism and prejudice go hand in hand (Iran is a case in point). ?A similar law has already been passed in Astrakhan.

Acer files suit against former CEO Gianfranco Lanci over non-compete breach

Gianfranco Lanci may be gone from Acer, but the PC maker's former chief is not forgotten -- not financially, at least. The company is suing the exec over non-compete violations, after he jumped ship around this time last year. The exec recently landed a gig at Lenovo as head of its Europe, Middle East and Africa division, after doing some time as a consultant for the company. Acer filed the suit in Lanci's native Italy, alleging that he "has clearly breached the terms" of the 12-month non-compete. No word yet on how much the company is seeking with the claim.

Bringing a 'wow' factor to West Palm's art fair | Palm Beach ...

Things are changing in the art world, changing fast.

The evidence will be on view at the 16th annual American International Art Fair, which opens in downtown West Palm Beach Friday for a 10-day run.

What began as an art and antique fair is making a transition to an art and design fair.

The colors will be stark ? black and white and gray, with LED lighting throughout the show. "There?s a movement toward minimalist works," says David Lester, whose company runs this fair and January?s ArtPalmBeach.

"A contemporary home tends to have white walls and neutral colors. The furnishings of today are rarely as ornate as in the past. Mar-a-Lago was typical of Palm Beach in its time, but today?s house is much more contemporary in nature."

The fair will still present a broad range, from 19th- and 20th-century paintings and photographs and sculpture to objects that are intrinsically beautiful, from a 17th-century Stradivarius violin to World War I-vintage automobiles.

A daily lecture schedule will cover everything from investing in art to discussions on Rembrandt, Faberg? and Chinese contemporary ink painting. The granddaughter of Andrew Wyeth will talk about her family?s paintings.

The idea, Lester says, is to present an eye-pleasing variety.

"We are like a movie theater ? we?re a platform. If you show Casablanca every night, after a week people get bored," says Lester. "My goal is to re-create a much more theatrical event in the convention center, as it was when we were in the big tent on Okeechobee ? more of a wow factor for collectors.

"We have to remember that we?re in the entertainment business ? shopping for cultural entertainment. Brown furniture is having a hard time; chrome is hot. We?re living in the day of the Droid and the iPhone, it?s not a black phone from Ma Bell anymore."

This broadening of definitions is taking place at the same time as a loosening of the purse strings, which was signaled last year when a lovely Renoir went for $9.8 million at the fair. Suddenly, art is selling again, on the high end and for younger, emerging artists.

"It?s much better than it was even two years ago," says Sarah Gavlak of the Gavlak Gallery in Palm Beach. "People are more confident."

What seems to be happening is that since conventional investments have had a rocky ride of late, people are much more interested in investing in tangible objects ? gold, silver, wine, art.

"When the market dips 400 points, and people scramble for liquidity," says Gavlak, "the greatest opportunity comes from blue- chip contemporary art. There?s less risk than there is in trading pork bellies. If you have a Warhol or a Rauschenberg, those objects and images have a built-in, absolute solid market value, and they can be sold in three days."

Things are jumping to such an extent that local artist Bruce Helander is now editing a glossy magazine called The Art Economist, which accepts no advertising and regularly lists the top 300 artists in terms of their auction prices.

For Helander, it?s a switch.

"In the ?60s and ?70s, for artists that were too commercial, made too much money, it was a negative. Now, Jeff Koons and Damien Hirst are celebrated in the marketplace. They?re labeled as geniuses by many, but they?re very strict marketers and money managers, and it shows. And it hasn?t taken away from their work."

The Internet has changed the way the collecting game is played, opening up a market that, as Helander puts it, was once as veiled as "a sheik?s daughter in the Dubai airport."

"If someone wants to find out what something is worth," says David Lester, "they can go online and look at the sale prices for a hundred pieces by that artist."

That resulting body of knowledge may also be why there?s a lot more bargaining than there used to be.

Lester feels that the traditional gallery system is failing, and that the growth is in art fairs and online, but then he?s not exactly unbiased. He points to the retail figures for December; conventional retail increased by a little less than 1 percent, online increased 17 percent. "That has to come at the expense of bricks and mortar," he says.

Gavlak says that despite the improved economy, which has resulted in a freer flow of money, quality remains of paramount importance.

"Look, anybody can buy merchandise, but if you?re serious about collecting art, it?s a different story," she says. "It?s about watching the artists of our time who are showing their ideas and watching them go from graduate school to a gallery to having well received exhibitions, to getting bought by museums and collections.

"When you get in on the ground floor of that, it?s very exciting, as well as a validation of your own taste."
